In 2000, Australia introduced the ESOS Act. The ESOS Act and regulations set out the legal framework governing delivery of education to overseas students studying in Australia on a student visa.
The Australian Government, through the Department of Education, Employment and Workplace Relations (DEEWR) administers the ESOS Act and its associated instruments.
ESOS ensures that Australian institutions must meet requirements for registration. If an institution fails to meet these standards for marketing activities, education delivery, facilities and student support services, they cannot be registered. This means that non-registered institutions are prevented from enrolling international students.
The ESOS legislation also provides consumer protection. This means students are guaranteed to receive the tuition for which they have paid for.

CRICOS is a database of over 1,000 registered Australian Education Institutions. To be able to recruit, enrol and teach international students the Australian education institution must be registered by CRICOS.
Students on a student visa must enrol with an education provider registered by CRICOS.
A school provider seeking to deliver a course/s of study to overseas students must be listed on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) prior to enrolling students from overseas. CRICOS is maintained by the Australian Government’s Department of Education, Employment and Workplace Relations (DEEWR) under the Education Services for Overseas Students Act 2000 (ESOS Act). CRICOS lists providers registered to deliver course/s to overseas students and the course/s they are approved to deliver. An overseas student is a person (within or outside) Australia who holds a student visa as defined by the ESOS Act.
